  AFFILIATED DONKEY SOCIETIES OF AUSTRALIA
Regulations for the Registration and Transfer of Donkeys and Hybrids

As revised in 2006

Until otherwise determined by the Affiliated Societies, the following shall be the Regulations of the Affiliated Societies. There will be a Registrar as determined by the Affiliated Societies from time to time.

The Register will be divided into four sections: The Jack Section, The Jenny Section, The Gelding Section, The Hybrid Section. There will also be a colt appendix.

THE JACK SECTION:

It will contain all registered jacks. Before registration, all jacks must carry an approved identification. A certificate of soundness must accompany every application for registration of a jack.

THE JENNY SECTION:

It will contain all registered jennies. Before registration, all jennies must carry an approved identification.

THE GELDING SECTION:

It will contain all registered geldings.

THE HYBRID SECTION:

It will contain all registered hybrids.

THE COLT APPENDIX:

It will contain all colts, not otherwise registered as jacks, up until their second birthday. No record will be kept of colts after their second birthday if they have not been registered as a jack or gelding.

TO REGISTER DONKEYS AND HYBRIDS:

1.       Only financial members of an Affiliated Donkey Society may apply for registration of their donkeys and hybrids.

2.       A donkey or hybrid may not be registered by anyone other than its lawful owner.

3.       Application for registration must be made on official application forms. These are available from the Registrar free of charge.

4.       The forms are in duplicate, the original to be sent to the Registrar and the copy to be retained by the member.

5.       All donkeys and hybrids must have a registered prefix as part of their name.

6.       The name of the donkey or hybrid shall not exceed 24 characters, including the prefix.

7.       The name of the donkey or hybrid cannot be changed unless it can be shown to cause confusion, or that a mistake was made by an officer of the Association. Such a change requires special permission.

8.       Donkeys in the Jack and Jenny Sections must bear a distinguishing identification such as a permanent brand, tattoo or electronic device, as approved by the ADSA.

9.       An application for the registration of a jack must be accompanied by a veterinary certificate of soundness.

10.    For parentage to be accepted and included in the registration records, a Service Certificate must be provided with the application for registration. Only registered jacks and jennies will be named as sire and dam.

11.    Only colour descriptions accepted by the Affiliated Societies will be included on the registration certificate.

12.    On any application for registration it is the responsibility of the owner to indicate that a donkey or hybrid has been imported.

13.    The Registrar will send to the owner a registration certificate showing the registered number of the
donkey or hybrid.

14.    The number given to a registered donkey or hybrid cannot be changed.

15.    The Registrar will send to an owner who enters a colt in the Colt Appendix an identification certificate showing the identification number and expiry date.

16.    A certificate may not be written upon by anyone other than the Registrar.

17.    If a registered donkey or hybrid is gelded, dies or is de-registered, the registration certificate must be returned to the Registrar with notification of the event and the correct dates. In the case of gelding, after the certificate is amended and signed by the Registrar it will be returned to the owner. In the case of death, the certificate will be returned at the owner’s request.

18.    Any jack or jenny showing breeding or hereditary defects may be refused registration or de-registered.

PREFIXES:

1.       All registered donkeys or hybrids and colts in the Colt appendix are required to have a registered prefix as part of their name. Prefixes will be registered with the Registrar on payment of a fee.

2.       The prefix shall be distinctive and not so resemble the prefix of any other breeder of stock, whether donkey or otherwise, whether in Australia or otherwise, as to be, in the opinion of the Registrar, misleading.

3.       The purchaser of a stud shall have no right to the previous owner’s prefix, except with the written sanction of the previous owner. Notification shall be given to the Registrar.

4.       A member can register a donkey or hybrid using his/her own stud prefix only with the following exception. In the case of a donkey or hybrid registered with another Donkey Society, the prefix will be accepted, and where the parentage of that donkey or hybrid would otherwise be shown, the words appear, refer to (name of other Donkey or Hybrid Society).

IDENTIFICATION:

1.       All donkeys in the Jack and Jenny sections are required to carry individual identification, being a brand, tattoo or electronic identification, according to the laws of each State and approved by the ADSA. The format acceptable to the ADSA is the registered identification of the member of the Affiliated Society, plus a means of identification of a particular donkey.

2.       The identification must be distinctive and not so resemble the identification of any other breeder of stock, whether donkey or otherwise, in Australia or elsewhere, as to be, in the opinion of the Registrar, misleading.

3.       The purchaser of any stud shall have no right to the previous owner’s brand or tattoo, except with the written sanction of the previous owner. Notification shall be given to the Registrar.

VETERINARY CERTIFICATES:

1.       An application for the registration of a jack must be accompanied by a certificate of soundness, stating that the jack is free from breeding and hereditary defects.

2.       The certificate must be signed by a veterinary surgeon.

SERVICE CERTIFICATES:

1.       Service certificates may be obtained free of charge by financial members of an Affiliated Society upon application to the Registrar.

2.       Only the registered owner or lessee of a registered jack can sign and issue service certificates.

3.       The certificate is in duplicate. One copy is given to the owner of the jenny or horse that has been served. This must be forwarded to the Registrar when the resulting foal is registered. The other copy is retained by the owner or lessee of the jack.

4.       When a jenny in foal is sold, the service certificate must be given to the new owner.

5.       If application is being made to register a donkey or hybrid which has been registered with another recognized Society (as determined from time to time by the ADSA) a copy of the registration certificate must be provided along with proof of ownership. All other ADSA regulations must be complied with in the application for registration.

TRANSFERS:

1.       Only financial members of an Affiliated Society may apply for transfer of their donkeys or hybrid.

2.       A donkey or hybrid may not be transferred by anyone other than its lawful owner.

3.       Only registered donkeys or hybrids, or those in the Colt appendix, may be transferred on an official
transfer form.

4.       Applications for transferring a donkey or hybrid must be made on official transfer forms, available from Registrar free of charge.

5.       The forms are in triplicate, one copy to be sent to the Registrar, one given to the purchaser and the other to be retained by the vendor.

6.       An application for transfer must be accompanied by the registration or identification certificate and the transfer fee, paid by the vendor.

7.       The Registrar will send the registration or identification certificate to the new owner, whether he is a member of an Affiliated Society or not.

8.       If a member purchases a registered donkey or hybrid from a person who cannot affect a transfer; he may apply to the Registrar to become the registered owner upon payment of a Special Transfer fee, providing that he can prove legal ownership.

LEASES:

1.       Where the donkey or hybrid is leased by one financial member of an Affiliated Society to another, normal transfer requirements apply - i.e. the owner puts in a transfer form at the time of transfer by lease, and the transferee submits a transfer form at the time when the donkey or hybrid is returned to its owner.

2.       The date of the termination of the lease must be stated on the transfer form.

3.       Subject to compliance with the above requirements - if the donkey is a jack, the member who leased it may sign a certificate of service for the owner of a jenny or horse for any service occurring during the period of the lease.

GENERAL REGULATIONS:

1.       The age of a donkey or hybrid shall be taken from its actual date of birth.

2.       There may be a Registration Sub-Committee consisting of three or four members of an Affiliated Society in each State, who may be given authority to inspect any donkey, hybrid, or record kept by any member of the Society, after a suitable notice, and to advise the Registrar of possible registration problems, such as serious breeding or hereditary defects.

3.       The Sub-Committee may not interfere with normal registration between members and the Registrar, but may, on written complaint from a member, request an inspection of the subject of the complaint.

4.       If anyone on the Registration Sub-Committee is found guilty by the ADSA of having personal prejudices, or of tampering with the quality of the Register for his own personal gain, he shall be relieved of his post by a meeting of the Affiliated Donkey Societies of Australia.

5.       An Affiliated Society shall inform the Secretariat and Registrar of members comprising the Registration Sub-Committee if requested.

6.       At all times, a member has the right of appeal to a meeting of the Affiliated Societies against a decision, and must be reminded of the rule.

7.       Any breeder of a donkey or hybrid, got by means of artificial insemination must submit a Certificate of Service from the owner of the jack, specifying the use of Al, and also submit a Certificate from the operator of the Al service.

8.       Progeny of a dam aged less than three years at the date of birth will be only accepted for registration as “parentage unknown”.
